Discrimination

An otherwise qualified individual cannot be discriminated against during any point in the job application and hiring process based on a disability. You will find information below regarding illegal discrimination and how to file a complaint if you feel you faced discrimination in the workplace.

Illegal Discrimination

The Equal Employment Opportunity Commission (EEOC) enforces multiple laws that prohibit discrimination based not only on disability, but also on race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), national origin, age (40 or older), or genetic information. If you feel you have been discriminated against during any point in the employment process based on your disability or any of the other aforementioned characteristics, you have the ability to file a charge to resolve the issue.

How do I file a charge?

In general, it will be important to move quickly when discrimination occurs. All of the laws enforced by EEOC, except for the Equal Pay Act, require you to file a Charge of Discrimination with them before you can file a job discrimination lawsuit against your employer. Non-federal employees and applicants typically must file a charge within 180 days of when the discrimination occurred. Federal employees and applicants, however, must file a charge within 45 days of the discrimination.
